Abstract
Cilj ovog rada jest pobliže objasniti problematiku rada maloljetnika u Republici Hrvatskoj, s naglaskom na rad u ugostiteljskim djelatnostima, te istaknuti sva prava, obveze I zaštitu istih koja proizlazi iz zakonskog okvira države. U početku se definiraju problem rada maloljetnika te faktori o kojima treba razmisliti kada govorimo o radu maloljetnika u Republici Hrvatskoj. U nastavku rada se definiraju osnovni pojmovi ugostiteljske djelatnosti I ugostiteljskog objekta u okviru Zakona o ugostiteljskoj djelatnosti. Na kraju se govori o zakonskom okviru rada gdje se daje pregled dijelova Zakona o radu, a posebice se daje uvid u onaj dio koji se odnosi na maloljetne osobe te se definiraju ograničenja rada ove osjetljive dobne skupine. Sve je to dovelo do zaključka da je zakonski okvir rada maloljetnika u Republici Hrvatskoj detaljan, precizan I sveobuhvatan, ali unatoč tome često smo svjedoci brojnih prijestupa.
Abstract (english)
The purpose of this paper is to explain the issue of working minors in Republic of Croatia, with emphasis on jobs in catering, and highlight all rights, obligations and protection of the same arising from the legal framework of the state. At the very beginning of the paper, the problem of the work of minors is defined and the factors that need to be considered when talking about it. Furthermore, the basic concepts of catering activity and catering facility are defined within the Law on Catering Activity. Finally, we talk about legal framework of work where an overview of parts of the Labor Act is given, and in particular an insight into the part that refers to minors and defines the restrictions on the work of this vulnerable age group. All of this has led to the conclusion that the legal framework of the work of minors in the Republic of Croatia is detailed, precise and comprehensive, but despite this we often witness numerous offenses.
