Abstract
Prethodna Direktiva 90/314/EEZ o putovanjima, odmorima i kružnim putovanjima u paket aranžmanima donesena je još 1990. godine. Dosada se znatno promijenilo tržište usluga putovanja. Struktura tržišta putovanja bila je mnogo jednostavnija te internet nije postojao. Modernizacija Direktive 90/314 / EEZ odgovara zahtjevima različitih dionika, jer je postojeća pravila bilo teško primijeniti u digitalnom dobu gdje potrošači sve više naručuju putem interneta. Usluge putovanja često se kombiniraju tako da se prilagode kupcu, a ne samo u obliku unaprijed utvrđenih paket aranžmana. Neke kombinacije nisu bile jasno obuhvaćene starom direktivom. Danas većina putnika rezervira putničke usluge putem interneta, a postupak rezervacije će utvrditi je li putnik rezervirao putni aranžman, povezani putni aranžman ili neke samostalne usluge. Direktiva (EU) 2015/2302 o putovanjima u paket aranžmanima i povezanim putnim aranžmanima donosi se kao direktiva maksimalne harmonizacije. Države članice neće moći uvoditi odredbe koje odstupaju od odredbi osim ako je to Direktivom(EU) izričito predviđeno. Da bi se osigurala jedinstvena razina zaštite potrošača, odredbe u nacionalnom pravu neće moći biti ni strože ni manje stroge od novih odredbi.
Abstract (english)
The previous Directive 90/314 / EEC on travel, holidays and package tours was adopted in 1990. So far, the travel services market has changed significantly. The structure of the travel market was much simpler and the internet did not exist. The modernization of Directive 90/314 / EEC meets the requirements of various stakeholders, as the existing rules have been difficult to apply in the digital age where consumers are increasingly ordering online. Travel services are often combined to suit the customer, not just in the form of pre-determined package deals. Some combinations were not clearly covered by the old directive. Today, most travelers book travel services online, and the booking process will determine if the traveler has booked a travel arrangement, an associated travel arrangement, or some stand-alone services. Directive (EU) 2015/2302 on package travel and linked travel arrangements is adopted as a maximum harmonization directive. Member States will not be able to introduce derogating provisions unless expressly provided for in the Directive. In order to ensure a unique level of consumer protection, the provisions in national law may be neither stricter nor less stringent than the new provisions.
