This paper deals with issues of responsibility for material defects in the purchase contract. This institute of compulsory rights, which serves as a strengthening of the mandatory relations, is governed by the Croatian Law on Obligatory Relations, which was enacted in 2005. Pursuant to the provisions of that law, the seller is liable for the material defects of the goods which he had at the time of the transition of the risk to the customer, irrespective of whether he was aware of it. The seller is also liable for material misstatements of things that arise after the transfer of the risk to the buyer if they are the cause of the cause that existed before. It is assumed that the deficiency that occurred within six months of the risk transfer has existed in the risk transfer, unless the seller demonstrates the opposite. After experiencing a disadvantage, buyers are obliged to do so within a certain timeframe, depending on whether there is a visible or hidden defect, informing the vendor about the defect they notice, otherwise they lose their rights. Rights of the buyer who promptly notifies the seller of the defect shall be released after the expiration of two years from the date of dispatch of the notice. All the obligations of the seller as well as the rights of the buyers in the event of material lack, the Croatian legislator sought to allign with Directive 1999/44 / EC of the European Parliament on certain aspects of the sale of consumer goods. A high degree of compliance of the Institute of Accountability for Material Disadvantages with Croatian Law in the Field of Consumer Protection has been achieved.
