The enactment of the Consumer Bankruptcy Act introduced the possibility of conducting bankruptcy proceedings against the property of all natural persons. The main goal is to release the postal consumer from obligations to his creditors. The procedure is carried out in several stages. The first phase is out-of-court proceeding before an intermediary in a counseling center with the aim of concluding an out-of-court agreement between the consumer and the creditor. If an out-of-court agreement is not concluded, second phase occurs, and an urgent consumer bankruptcy procedure is conducted before the competent municipal court. The third phase is the opening of court proceeding, which can be opened only if the court determines the existence of a bankruptcy reason, and that is if the consumer is insolvent. After the court determines the reasons, it makes a decision on opening the procedure or opening and concluding the consumer bankruptcy procedure. With the decision on concluding the bankruptcy procedure of the consumer, the court will determine the period of verification of conduct, which cannot be shorter than one year or longer than five years. During the verification period, the commissioner is obliged to liquidate and distribute the consumer's property in accordance with the Law and the final distribution list. After the expiration of the period of verification of the conduct, the court issues a decision on release or denial of release from obligations. The simple procedure is an accelerated and simplified procedure aimed at settling creditors and reducing the number of long-term blocked citizens, which enables rights at another opportunity.
